EU told to dismiss Spanish patenting woes

The case put forward by Spain against the single EU patent should be dismissed, the advocate-general of the EU has said.

Yves Bot, advocate-general of the EU, has issued a statement saying that the package of regulations approved to establish the unitary patent system is necessary because it guarantees that the implementation of the patent system would be uniform through Europe and would enhance its integration. Spain’s challenges to this package should be dismissed because they are unfounded, he added.

“The unitary protection conferred provides a genuine benefit in terms of uniformity and integration, while the choice of languages reduces translation costs considerably and safeguards better the principle of legal certainty,” Bot said in a statement released on 18 November.
